Clínica Lambert provides legal medicine expertise related to body injury evaluation within several Laws: Civil, Labour, Criminal, Administrative and Family Law and the fields of Forensic Psychiatry and Psychology.
Medical evaluations on body injury are performed, followed by legal medicine reports and analysis and, in case of need, medical follow up of the injured at Court is also possible. Evaluations from Insurance Companies and Health Institutions are also performed (Labour Court, ADSE, Social Welfare – SS, Caixa Geral de Aposentações – CGA, Juntas Militares).
Within the area of post-traumatic body injury evaluation, physical and psychological injuries are assessed. This way, it is possible to establish if there are temporary and/or permanent injuries, that might be object of criminal penalty, compensation, tax and/or social benefits. At the same time, it may be necessary to request supplementary imaging or evaluation by other medical specialties.
These may be framed within several Laws, such as:
Civil Law: It aims to assist the Court in providing adequate compensation for injuries suffered as a result of accidents (traffic, work, leisure, personal, sports), aggression, medical liability.
Labour Law: The consequences of accidents at work for workers in the private sector are assessed. It includes accidents during work, for workers in the public sector, and diseases related to the job.
Criminal Law: The injuries are judged according to the Portuguese Criminal Code.
This way, it is possible to classify crimes against physical integrity and crimes of sexual nature as a criminal offense. Examples of these are attacks, traffic accidents, car accidents, leisure/sports accidents, medical liability, domestic violence, physical abuse, child and elderly abuse and sexual abuse.
